A DEVELOPER has lodged an appeal against a decision not to allow a takeaway to open in a residential area.
Developer S Gecin hoped to open the takeaway in William Harris Way, in Colchester.
To do that, the building requires a change of planning consent from retail to restaurant.
But the plans were met with strong opposition from residents, who said opening the takeaway would harm the area.
They had also claimed they had bought their homes, in the immediate vicinity, on the understanding no hot food outlets would ever be considered for the area.
During a Colchester Council planning meeting in November, councillors decided the proposals were “problematic”.
Mr Gecin has lodged his appeal with the Planning Inspectorate. A hearing date is yet to be fixed.
